Beachside Vacations Guest License Agreement

This Agreement shall be interpreted and enforced according to the laws of the State of South Carolina. The invalidity or unenforceability of anyone or more provisions of this Agreement shall in no way effect any other provisions. This Agreement may not be transferred or assigned.

Ownership

The property is privately owned, with Beachside Vacations, LLC acting solely as AGENT for the OWNER. The GUEST acknowledges he is a licensee of the OWNER and not a tenant, and is not acquiring any interest in the property.

Payment

A rental deposit of 35% of the total price is due at the time of booking the reservation. The balance in full is due forty-five days prior to check-in. We accept MasterCard, VISA, Discover, and American Express as forms of credit card payment. Other forms of payment include checks and money orders payable to the AGENT. If there is a payment via check or money order, the balance is due at least forty-five days prior to check-in. No personal checks accepted within 45 days of your arrival date. Signed Vacation Rental Agreement and Payment are required to confirm reservation. A $30.00 returned check fee would be assessed to the reservation if a GUEST’S check should be returned for any reason. Should the AGENT not receive the final balance by this due date, the GUEST authorizes the AGENT to charge the balance due on the reservation to the GUEST’S credit card on file. Reservations made less than thirty days prior to the arrival date must be paid in full at the time of booking. 

Rates

Errors in pricing and descriptions rarely occur and the GUEST will be notified in any event of error. If in the opinion of the AGENT, the error substantially changes the terms of this Agreement, the GUEST may cancel the reservation within five business days after receiving such notification and the GUEST will receive a full refund. We reserve the right to make corrections, additions, deletions, and changes in the rates and descriptions at any time without notice. Should the accommodation become unavailable due to reasons beyond control, the AGENT will provide alternative accommodations and will notify the GUEST. Taxes and fees are not included in quoted rates.

Advance Reservations

Reservations made before the beginning of a calendar year on a property that does not yet have set rates, require a 35% deposit based on the prior year's rates and are subject to price adjustments, owner's right to occupy, and adjustments in amenities. GUEST will be notified of final rates and availability as soon as possible. GUEST may elect to accept new rates and terms, and pay the balance due for a 35% deposit or cancel the reservation without penalty. Failure to agree to the new terms within 30 days of notification or failure to send the remaining balance due on the 35% deposit will result in cancellation of this Agreement, and GUEST will receive a FULL refund. If the rates have been set for the following year, then normal deposit and cancellation policies apply. 

Taxes and Fees

Taxes and fees are not included in quoted rates. 14.5% state sales tax; state and local accommodations taxes (13.5 % Sullivan’s Island) plus a 7.5% reservation fee are added to all rentals. Final tax rates are calculated according to state and local taxes in force at time of occupancy. GUEST is responsible for payment of all applicable taxes in effect at time of occupancy.

Groups

Absolutely no house parties, youth groups, fraternities, weddings, receptions, meetings or parties allowed. AGENT does not rent to students or groups of students under any circumstances. If such a group occupies or attempts to occupy the property, it will be required to immediately vacate and there will be no refunds. Registered GUEST must be over the age of 24.

Emergencies

The GUEST agrees that the AGENT and/or contractors or employees may enter the premises when the AGENT deems it necessary. 

Cancellations

ALL GUEST CANCELLATIONS MUST BE IN WRITING. To protect all parties, the AGENT has a strictly enforced policy for cancellations. Cancellations received within three (3) days of the reservation booking are subject to a full refund. Prior to forty-five (45) days of the reservation arrival date, a GUEST may cancel with a cancellation fee equal to ten (10) percent of the total rental rate. Cancellations made within forty five (45) days of the reservation arrival date, would result in the forfeiture of all payments made. If a reservation is cancelled and the property is rebooked at the same rate, the GUEST may request a refund less the ten (10) percent cancellation fee. There are NO Exceptions. A home that is unacceptable to the GUEST is considered a cancellation. The AGENT may cancel a reservation if, in its sole opinion, it is in the best interest of the OWNER. Beachside Vacations is not responsible for the weather evacuations or other Acts of God, and there will be no refunds. Travel insurance is recommended.

Damages

As a GUEST of Beachside Vacations, your rental includes a damage waiver benefit. Beachside Vacations will waive the cost of, and you will not be obligated to pay for, reported lost or accidental damage to the contents of the rental accommodation you occupy. The damage waiver is limited to a maximum of$2000 damage payment per stay and terminates upon departure/check out. Cost of the damage waiver benefit is non-refundable. All damages at the property MUST be reported promptly to Beachside Vacations staff, who will determine the extent of repairs necessary. If damage is not reported prior to departure, the damage waiver is void. The GUEST agrees to indemnify the Owner for any damages caused by their carelessness and negligence including, but not limited to damaged property, missing accessories, and missing or damaged linens. The AGENT has full authority from the Owner to collect for damages at the AGENT’s discretion. Credit card damage deposits are not actually charged unless damages occur and/or excessive cleaning is required. In that event, invoices and credit card receipts will be mailed. The AGENT requires that a valid credit card be presented by the GUEST at the time of check-in. This card shall be recorded and used for any damages or missing items that are deemed the responsibility of the GUEST by the AGENT. Should the property be found in an unacceptable condition (excessive trash, excessive laundry or generally neglected) following check out, AGENT has the right to charge GUEST additional cleaning fees.

Internet

High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rentals shall be given for outages, content, lack of content, speed, access problems, and lack of knowledge of use or personal references with regard to Internet service. Assistance with your personal computer and Internet service will be based on a standard rate of $35.00 per hour. Further Internet instructions can be found in the Beachside Vacations Guest Directory located in the living area of each vacation home. Internet support is offered every day during business hours 9:00 a.m. to 5:00 p.m.

Maintenance

The AGENT is not responsible for air conditioning or any other appliance that fails to operate properly or for other maintenance issues including, but not limited to, pest control and housekeeping and no refunds will be given. The GUEST agrees to notify the AGENT as soon as a maintenance problem occurs. Breakdowns and other maintenance issues will be repaired or replaced as quickly as possible. No refunds or compensation will be given. Maintenance support is offered every day during business hours 9:00 a.m. to 5:00 p.m. After hours emergency maintenance support is available for items such as complete loss of power, loss of air conditioning throughout entire house, severe water leaks or fire.

Smoking

Smoking is NOT permitted inside any vacation property at any time. If smoke is detected inside the property, applicable cleaning fees will be charged to the GUEST’S credit card on file. 

Pets

ABSOLUTELY NO PETS ARE ALLOWED unless the property description specifically approves pets. If pets are found in a property that does NOT allow pets, all monies will be forfeited, and you will be required to vacate the property. If a property specifically permits pets, a $250 pet deposit is required.

Motor Homes, Trailers, Boats, Motorcycles

Motor homes, trailers, boats and motorcycles are NOT allowed in Wild Dunes Resort or at any condominium property. City ordinances do not permit any motor homes or buses to be parked at a licensed short-term rental property.

Disturbances/Noise Ordinances

The Isle of Palms and Sullivan’s Island have strict ordinances governing noise. Occupancy and use of the premises and amenities shall not be in a manner that disturbs residents or other GUESTS. If any GUEST creates a private or public nuisance, AGENT has the right to terminate this Agreement and require that all GUESTS vacate, with no refunds.

Occupancy

The GUEST will restrict occupancy to the stated limit for the reserved property at all times. Occupancy, use of the premises and communal areas, shall not disturb or offend GUESTS or residents. The AGENT has the right to terminate this Agreement and evict disruptive GUESTS without a refund. Moving furniture/wall hangings is not allowed.

Elevators

The GUEST agrees to indemnify the Owner for any damages caused by their carelessness and negligence including, but not limited to damages/repairs with the elevator in the home. ANY service calls and charges made by GUEST due to operator error or negligence will be the responsibility of the GUESTS including but not limited to after hour calls. The AGENT has full authority from the Owner to collect for service calls and damages at the AGENT’S discretion. 

Private Swimming Pools

All spas and pools are under the care of independent contractors. These individuals are responsible for servicing all spas and pools weekly. It is possible in between services the pool may lose water or chemicals or show signs of dirt (especially in stormy weather). Due to our near constant wind, there may be some sand on the bottom. If you feel there is a problem with your pool, please call our office prior to use. We invite you to use the nets or brushes provided in between weekly services to keep pools in good condition. Spa and pool heaters are made up of electrical and mechanical components, which can malfunction. Beachside Vacations, vendors and owners will not be held responsible for the failure of the same however we will do everything within our power to remedy the difficulty as soon as possible. Spa and pool heat can also be affected by the external temperature, especially in the cooler months. Temperature of the spa and pool can only be set by the pool service contractor. If the heater is found to be operating correctly but not providing heated water due to the temperatures, neither refund nor compensation will be given. You are to report immediately if your pool is not heated. Should a problem be the result of the pool heater, you will be refunded the additional pool heating fee from the day you report the problem with no further compensation. Spa and pool call outs are only available during working hours,9:00 a.m. to 6:00 p.m. Should GUESTS require attention that is non-emergency related (i.e. pool not heating) there will be a call out charge of $50.00. If you have elected to heat a pool and spa, a daily fee of $50.00 to $150.00 will be applied to your account. Spa and pools are scheduled to be turned on the morning of your arrival date if elected to be heated. Please note the pool and spa may take up to 24 hours to reach the temperature set by the pool contractor.

Trash Service

Beachside Vacations offers a twice weekly trash service from Memorial Day through Labor Day and once weekly trash service after Labor Day. Please DO NOT ROLL TRASH CARTS to curbside, as we provide this service. The City of Isle of Palms has strict rules and regulations regarding trash roll out times, where fines are incurred to the property. Fines incurred from GUEST rolling trash bins to curbside at a property, will be the responsibility of the GUEST. 

Pest Control

We are located in a low-lying area; pest control services are performed regularly. To keep the pest population under control, the GUEST agrees to allow pest control operators access to the property. Please keep in mind, Charleston, also known as the Lowcountry, has a sub-tropical climate and care must be taken with food that is left uncovered to prevent pests.

Check In and Check Out

The GUEST acknowledges and understands that check-in is no earlier than 4:00 PM (April-September) and the check-out is no later than 10:00 AM. If departure is later than 10:00 AM, penalties will be assessed. There will be no refund for early departures for any reason, weather- related or otherwise. AGENT makes reasonable efforts to ensure that the property is ready for the GUEST arrival. However, due to the seasonal nature of our business, all properties may not be cleaned by check-in time. No refunds will be given should this occur. Departure cleaning is provided. 

Prior to departure, GUESTS are asked to leave the home in a neat and orderly fashion.

Furniture arranged as it was found.

Remove all garbage from every room, and take it to the appropriate outside container. 

Clear the kitchen of trash and food.

Carpets and floors should be free of excess debris and sand. 

Load the dishwasher and start cleaning cycle. 

Please check for all of your personal belongings. Remember to report any damages that occurred during your stay to the office, so the appropriate damage policy claim form can be completed.

Interest

In accordance with South Carolina license law, disclosure is hereby given that the AGENT escrow account is an interest bearing account, with the interest being to the benefit of the AGENT.

Lost Items

The AGENT is not responsible for any personal belongings of the GUEST that may become lost, stolen, damaged, or left behind. The items will be returned to the GUEST at the GUEST’S expense. If the items are left unclaimed with Beachside Vacations over 30 days, the items will be donated to a local charity. 

Sullivan’s Island Addendum 

GUESTS renting on Sullivan’s Island are required to sign a special addendum provided by the City. This addendum will be provided upon arrival and must be returned to the AGENT.  

Property Description

Cancellation Policy: Travel Protection Insurance

Beachside Vacations has partnered with Red Sky Travel Insurance to provide Trip Preserver coverage for our guests.  Trip Preserver provides trip insurance, emergency assistance and travel services, hurricane evacuations and family emergencies such as illness or death in the family.  The cost is 7% of your total rent.  The fee is due with your first payment for full coverage including pre-existing illness.  It is non-refundable.  We strongly urge you to consider this insurance when planning your Carolina Coast vacation.  No refunds will be made for hurricane evacuations without trip cancellation insurance. 

Trip Preserver from Red Sky covers trip cancellation or interruption due to:

A named hurricane or other natural disaster that results in a mandatory evacuation

Inhabitability of the destination vacation home caused by a natural disaster

Inhabitability of your primary residence or your traveling companion’s primary residence caused by a natural disaster

Sickness, injury or death of you, a family member or traveling companion.

Involuntary termination of employment or transfer of employment

Extension of school year

I have read, understood, and further agree to the above provisions.  I agree that I will be responsible for any fines levied as a result of any actions by a family member or guest while I am staying at the PROPERTY.
